(AP) ? The 17 European Union nations that use the euro have struck an agreement with the International Monetary Fund on a program to reduce Greek debt and put Athens on the way to get the next installment of its much-needed bailout loans.

The first disbursement is set to take place Dec. 13, said Jean-Claude Juncker, head of the eurogroup of finance ministers, after Tuesday's decision.

Mario Draghi, President of the European Central Bank, said markets should pay heed. "It will certainly reduce the uncertainty and strengthen confidence in Europe and in Greece."

This was the third time in the last two weeks that finance ministers from the eurozone had tried to hammer out a deal on the next installment of bailout money ? some ?44.6 billion ($57.8 billion).

In Athens, Prime Minister Antonis Samaras welcomed it as a great victory. "As Greeks, we fought together. And tomorrow a new day begins for all Greeks."

And the EU lauded all Greeks for holding their country back from the brink.

"We strongly believe in the Greek capacity to recover. The Greek people are courageous people. They are willing to bring their country back on the path of growth," Juncker said.

The so-called troika of the European Central Bank, IMF and the European Commission, which is the 27-country EU's executive arm, have twice agreed to bail out Greece, pledging a total of ?240 billion ($310 billion) in rescue loans ? of which the country has received about ?150 billion ($195 billion) so far. In return for its bailout loans, Greece has had to impose several rounds of austerity measures and submit its economy to scrutiny.

Greece is predicted to enter its sixth year of recession shortly and has a quarter of its workforce out of a job, and there had been fears it might be forced to drop out of the eurozone, destabilizing other countries in the process.

The main aim of the bailout program is to right Greece's economy and get it to a point where it can independently raise money on the debt markets. It has been clear for months that the country is far from achieving that goal. The talks have centered on trying to get Greece back on the path to sustainability by reaching an agreement on how the country's debt load can be reduced.

Juncker said the agreement includes:

? A plan to reduce Greece's debt level to 124 percent of its gross domestic product by 2020 and below 110 percent by 2022. The IMF had originally insisted on a debt-to-GDP ratio of 120 percent by 2020.

?A cut of 100 basis points on the interest rate charged to Greece by other eurozone member states ? excluding those that are also receiving bailouts.

?A 15-year extension of the maturities of loans from other countries and the eurozone's bailout fund, the European Financial Stability Facility, and a deferral of interest payments by Greece on EFSF loans by 10 years.

"This is not just about money," Juncker said. "It is the promise of a better future for the Greek people and for the euro area as a whole."

The head of the IMF, Christine Lagarde, also said the agreement was significant.

"We wanted to make sure that Greece was back on track," Lagarde said. "If you put it all together it is a significant amount."

Greece will get ?34.4 billion ($40.84 billion) straight away and the rest in separate installments in January, February and March.

The political agreement reached Tuesday will have to be submitted to parliaments in some countries. After that, the finance ministers plan to hold another meeting, either in person or by telephone, to give final approval to the disbursement.

(AP) ? For decades, conservative lobbyist Grover Norquist vowed to drive Republicans out of office if they didn't pledge to oppose tax increases. Many lawmakers signed on.

But now, several senior Republicans are breaking ranks, willing to consider raising more money through taxes as part of a deal with Democrats to avoid a catastrophic budget meltdown.

Tennessee Sen. Bob Corker says the only pledge he will keep is his oath of office. House Majority Leader Eric Cantor says no one in his home state of Virginia is talking about what leaders in Washington refer to simply as "The Pledge," a Norquist invention that dates to 1986. Georgia Sen. Saxby Chambliss says he cares more about his country than sticking to Norquist's pledge.

It's quite an about-face for senior members of a party that long has stood firmly against almost any notion of tax increases. And while GOP leaders insist they still don't want to see taxes go up, the reality of a nation in a debt crisis is forcing some to moderate their opposition to any movement on how much Americans pay to fund their government. Republican legislators and Democratic President Barack Obama's White House are haggling vigorously as they look for ways to reach agreement on detailed tax adjustments and spending cuts before automatic, blunt-force changes occur at the new year.

"Oh, I signed it," Sen. Jeff Sessions of Alabama said on Fox News about Norquist's pledge, adding he still supports its goals. "But we've got to deal with the crisis we face. We've got to deal with the political reality of the president's victory."

The naysaying about the pledge is raising the question of whether Norquist ? a little-known Republican outside of Washington ? is losing his position of power within the GOP. It's a notion that he calls ridiculous.

"Nobody's turning on me," Norquist said Monday.

But he indicated he would turn on lawmakers who defy him, starting with Corker, who Monday published an opinion piece in The Washington Post outlining an alternative to the budget breakdown that includes more revenue.

"Corker was elected to the Senate because he took the pledge," Norquist said on Fox News. "He would not be a senator today if he hadn't made that commitment. If he breaks it, he's going to have to have a conversation with the people of Tennessee about his keeping his word. And the same thing with other people who are elected because they made that written commitment to the people of their state."

At the White House, spokesman Jay Carney said Monday that the shifting away from Norquist signaled an opportunity for Republicans to work with President Obama.

"They represent what we hope is a difference in tone and approach to these problems and a recognition that a balanced approach to deficit reduction is the right approach," Carney said.

Norquist, the head of the conservative Americans for Tax Reform, opposes tax increases of any kind, whether eliminating deductions, a position some GOP lawmakers say they're open to, or raising rates. He has insisted on hardline positions from lawmakers and, for years, has held outsized sway in the party for someone who does not hold public office. His pledge doesn't allow any change to the tax code that adds a dollar to revenues.

House Speaker John Boehner has called that notion unrealistic and has dismissed Norquist as "some random person."

Nevertheless, Norquist has maintained a certain level of clout for years.

Heading into the 2012 elections, 279 lawmakers had signed Norquist's' pledge, according to Americans for Tax Reform.

But some who have signed the pledge are having second thoughts. And when the new House is seated next year, no more than 212 of them consider themselves bound by the promise.

"I'm not obligated on the pledge," Corker told CBS News. "I was just elected. The only thing I'm honoring is the oath I take when I serve when I'm sworn in this January."

He's not alone in his stance on the pledge.

"When I go to the constituents that have re-elected me, it is not about that pledge," Cantor said on MSNBC. "It really is about trying to solve problems."

Chambliss, a veteran senator from Georgia, said he signed the pledge during an earlier campaign when the country's debt was nowhere near its current $16 trillion level.

"Times have changed significantly, and I care more about my country than I do about a 20-year-old pledge," Chambliss told his local television station. "If we do it (Norquist's) way, then we'll continue in debt."

"I'm frankly not concerned about the Norquist pledge," Chambliss added.

Raising taxes, whether by closing loopholes or raising tax rates, is seldom a vote-winning strategy.

President George H.W. Bush broke his campaign promise to not raise taxes; he ended up losing re-election 1992.

Other Republicans, however, now are willing to put additional tax revenues on the table as a bargaining chip for a deal with Democrats to get changes in Social Security and Medicare and pare down federal deficits.

"I agree with Grover, we shouldn't raise rates. But I think Grover is wrong when it comes to we can't cap deductions and buy down debt," Sen. Lindsey Graham of South Carolina said Sunday on ABC's "This Week."

"I will violate the pledge ? long story short ? for the good of the country, only if Democrats will do entitlement reform," he added.

Rep. Peter King of New York told Sunday's "Meet the Press" on NBC that the pledge is good for a two-year term only.

"A pledge you signed 20 years ago, 18 years ago, is for that Congress," King said. "For instance, if I were in Congress in 1941, I would have signed a support of declaration of war against Japan. I'm not going to attack Japan today. The world has changed, and the economic situation is different."

And Sen. John McCain, his party's presidential nominee in 2008, said the pledge is losing its clout.

"Fewer and fewer people are signing this, quote, pledge," he told an audience recently.

Rice's star rises as congressional opposition dims

WASHINGTON (AP) ? With congressional opposition softening, U.N. Ambassador Susan Rice could find her name in contention as early as this week to succeed Hillary Rodham Clinton as secretary of state. It's a step that may signal greater U.S. willingness to intervene in world crises during President Barack Obama's second term.

As Obama nears a decision on who should be the country's next top diplomat, Rice has emerged as the clear front-runner on a short list of candidates that many believe has been narrowed to just her and Sen. John Kerry, despite lingering questions over her comments about the deadly Sept. 11 attack on a U.S. Consulate in Libya.

According to congressional aides and administration officials, Rice will be making the rounds on Capitol Hill this week for closed door meetings with key lawmakers whose support she will need to be confirmed. Those appearances follow her first in-depth explanation of her Benghazi remarks that Republicans seized on as evidence of the administration's mishandling of the attack that took the lives of the U.S. ambassador to Libya and three other Americans.

Acting CIA Director Michael Morell will join Rice in her meetings with lawmakers.

A senior Senate aide said the administration was trying to measure the strength of the Republican opposition to a Rice nomination, sounding out the more moderate members of the Foreign Relations Committee such as Sen. Bob Corker, R-Tenn., who is in line to become the panel's top Republican next year, and Sen. Johnny Isakson, R-Ga.

Rice is scheduled to meet on Tuesday with Sen. John McCain, R-Ariz., her most vocal critic on Capitol Hill. She will also meet with Sen. Kelly Ayotte, R-N.H. McCain and Ayotte are members of the Armed Services Committee.

During an interview on Monday, McCain said he would ask Rice "the same questions I've been talking about on every talk show in America." Asked whether he thinks she's still unfit for secretary of state and what he was hoping for, McCain interrupted and said, "I'm not hoping for anything. She asked to see me and I agreed to see her."

Assessing the prospects for Rice before Obama makes any announcement would avoid the embarrassment of a protracted fight with the Senate early in the president's second term.

On talk shows the weekend following the attacks, Rice relied on talking points provided by the intelligence community that described the attack as a spontaneous assault growing out of a protest of an anti-Muslim film. GOP critics say her remarks downplayed evidence of an obvious terrorist attack just weeks before the Nov. 6 election.

Republicans called her nomination doomed, leading to a vigorous defense of her by Obama in his first post-election news conference. But since then, GOP lawmakers seemed to have softened their views. McCain, who said earlier this month that would he do everything in his power to scuttle a Rice nomination, said on Sunday that he was willing to hear her out before making a decision. McCain ally Lindsey Graham, R-S.C., has also eased his opposition and said he is usually deferential to presidential Cabinet picks.

Sen. Jim Inhofe, R-Okla., a member of the Foreign Relations Committee, had issued a statement highly critical of Rice on the day of Obama's news conference. He indicated Monday that perhaps she didn't know what had transpired in Benghazi on the day of the attack.

"I assumed she had full knowledge of everything that went on. I'm not at all convinced of that now. She very well could have been thrown under the bus," Inhofe said in an interview. He said she hadn't requested a meeting but he would be glad to meet with her.

White House spokesman Jay Carney said Monday that the administration appreciated McCain's latest comments about Rice, but wouldn't say whether the president saw them as an opening to make the nomination. "Ambassador Rice has done an excellent job at the United Nations and is highly qualified for any number of positions," Carney said.

Several diplomats currently serving with Rice said that what she lacked in Clinton's star power, she could make up with a blunter approach that demands attention and has marked her tenure thus far at the United Nations.

Rice, who at 48 is relatively young, has played the role of "conscience of the administration" on human rights and detainee issues and would bring "a certain edge" to the secretary of state job, according one colleague who has dealt with Rice on multiple issues over the past three years.

She "will not be going into the job as a star," said Karl Inderfurth, a former U.S. ambassador and senior State Department official who worked closely with Rice in President Bill Clinton's administration when she worked as a staff aide to the National Security Council and then as assistant secretary of state for African affairs. "She will be a rising star, though."

"Hillary Clinton understood the politics of diplomacy: what the person across the table needs in order to sell something," said Inderfurth, now at the Center for Strategic and International Studies think tank in Washington. "Susan Rice's background is different. What she'll bring is her experience in multilateral engagement and the limitations thereof."

"But the most important thing she brings to the table is her relationship with the president," Inderfurth said.

Rice, like many other foreign policy experts of her generation, was shaped by the Clinton administration's inability to prevent the genocide of hundreds of thousands of ethnic Tutsis and moderate Hutus in Rwanda 1994. Years later, she told a journalist: "I swore to myself that if I ever faced such a crisis again, I would come down on the side of dramatic action, going down in flames if that was required."

That doesn't mean the U.S. will change its policy of only providing humanitarian support to Syrian rebels fighting to overthrow the regime anytime soon. But Rice's confirmation as the next secretary of state could alter the balance in an administration that has viewed humanitarian interventions with significant skepticism, given its rejection of the Bush administration's war in Iraq.

An early supporter of Obama's 2008 presidential campaign, Rice fell out with some of her Clinton administration-era NSC and State Department colleagues who urged her to support Hillary Clinton's competing candidacy, including her own mentor, Madeleine Albright, and some of her top aides.

With the Clinton-Obama primary battle in full gear in April 2008, tension between the two camps was on public display at a ceremony and reception to unveil Albright's official portrait in the State Department's ornate 8th floor Benjamin Franklin room, according to several people present. At those events, Rice firmly brushed aside appeals that she switch allegiance, those present said.

Obama's 2008 election brought with it the prospect that Rice, one of his campaign's top foreign policy advisers, might be in line for the Cabinet job she is known to covet. Instead, however, Obama went with the surprise choice of Clinton and gave Rice the U.N. portfolio, although he attempted to deflect her disappointment by restoring the job to a Cabinet-level position.

But her sights remained set on the top job, according to people who know her.

Since arriving in New York, Rice can point to a series of diplomatic achievements ? most notably the NATO-led air campaign that toppled Libyan leader Moammar Gadhafi and tougher sanctions against Iran and North Korea over their nuclear programs.

But Rice has also been criticized ? along with other Security Council leaders ? for the failure of the U.N.'s most powerful body to take action to end the 19-month civil war in Syria.

She has also been criticized, especially by human rights groups, for being too protective of U.S. allies, namely Sri Lanka where the U.N. says up to 40,000 ethnic Tamil civilians may have been killed in the final months of the country's civil war that ended in May 2009, and Rwanda, which has been accused of backing the M23 rebel group that last week took control of the eastern Congo city of Goma.

As U.N. ambassador, she has gained a reputation for a sharp intellect and sharp elbows. She is not known for diplomatic finesse, rather for being aggressive ? sometimes too aggressive ? and using salty language on occasion. In private, she has a good sense of humor.

In a legendary exchange last December, Rice dismissed an appeal by Russia's U.N. Ambassador Vitaly Churkin, who also isn't afraid to speak out, for a Security Council investigation of civilian deaths in Libya from NATO's bombing campaign as "a cheap stunt" to distract attention from the Syrian conflict.

"Oh, the bombast and bogus claims," she told reporters.

Churkin responded by mocking Rice's Stanford University degree, saying: "We hear that the Obama administration wants to establish a dialogue with the international community in the United Nations... If this is the intention, really this Stanford dictionary of expletives must be replaced by something more Victorian."

How can I switch my 401k to a rooth IRS with out ... - Roth IRA News

A roth account might be good or bad for you. They?re not good for everyone.

A 401k or IRA is just a type of account, and has nothing to do with how much of a return you can get from your investment. If you are investing in mostly a diverse mix of stock funds, you should expect a long term average return of 7-9%. In some years you will get more (like 13%), and some years you will lose money). In either type, you?ll be investing in a mix of mutual funds. The benefit of a roth IRA has to do with taxes.

Here?s the benefit: With a 401k or traditional IRA, you pay no income taxes now on the money you put in. You pay income taxes when you withdraw the money in retirement. With a roth IRA, you pay the income taxes now, and pay no taxes on the money you withdraw in retirement.

If your income tax rate is lower now than it will be in retirement, you do not want a roth account. If your income tax rate will be higher in retirement than it is now, then a roth account would be good for you.

HERE?S HOW YOU SWITCH:
You ?rollover? your 401k balance to a traditional (pretax) IRA. That means you tell the company that has your 401k to transfer the money directly into an IRA. As long as you don?t receive a check payable to yourself, you?ll pay no taxes or penalties. You then ?convert? the traditional IRA to a roth IRA. This is something the company that handles the IRA does for you. Basically, they take taxes straight out of the IRA and send them to the IRS. This makes the money in the IRA after tax, or ?roth? money.

BUT?

To be able to transfer the money from the 401k to the IRA, you?ll have to have already stopped working for the company. AND your company might have the ?roth 401k? feature, which allows you to contribute to your 401k plan with after tax money and have exactly the same benefit as the roth IRA. ALSO if your company matches your contributions to your regular 401k, that will probably outweigh any benefit you could possibly get from the roth IRA.

You need to talk to the company that manages your 401k plan to find out what your options are. And call a company that does IRAs to find out more details on the roth IRA to find out if it would be a good fit for you. Try Fidelity or Vanguard.

Egypt protesters, police clash after Morsi decree

Fresh from winning praise for brokering the Gaza cease-fire, Mohammed Morsi sets Egyptian politics ablaze by granting himself sweeping new powers. NBC's Jim Maceda reports.

By NBC News staff and wire reports

Updated at 5:05 p.m. ET:?Opposition protesters clashed with police in several Egyptian cities Friday after new Islamist President Mohammed Morsi awarded himself sweeping new powers.

Police fired tear gas in an attempt to disperse tens of thousands of protesters in Cairo?s Tahrir Square, the center of anti-regime protests that ousted longtime U.S.-backed leader Hosni Mubarak in 2011.

"The people want to bring down the regime," shouted protesters, echoing a chant used in the anti-Mubarak uprising. "Get out, Morsi," they chanted.

State TV also said Morsi opponents set fire to Muslim Brotherhood offices in the Suez Canal cities of Suez, Port Said and Ismailia.

Clashes also erupted between police and opposition protesters in the Mediterranean city of Alexandria, the southern city of Assiut and in Giza, the sister city of the capital. In Alexandria, Morsi opponents hurled stones at Brotherhood supporters outside a mosque and stormed a nearby office of the group.

However, Muslim Brotherhood backers gathered in front of the presidential palace in northern Cairo to support Morsi -- illustrating a widening gulf over Egypt?s future.

Tarek Fawzy / AP

Protesters opposed to President Mohammed Morsi break into the offices of the Freedom and Justice Party, the political wing of the Muslim Brotherhood, in Alexandria, Egypt, on Friday.

Wide powers
Buoyed by accolades from around the world for mediating a truce between Hamas and Israel, Morsi on Thursday ordered that an Islamist-dominated assembly writing the new constitution could not be dissolved by legal challenges.

Other changes give Morsi power to take security measures to protect his position, which rights groups say are like new emergency laws.

Morsi belonged to the Muslim Brotherhood until he ran for the presidency and still depends on the group for political support.

On Friday, Morsi confirmed that he will move forward on his plans because he insisted they were for the good of the country.

Complete coverage of the Middle East & North Africa?

"I am for all Egyptians. I will not be biased against any son of Egypt,'' Morsi told the crowd outside the presidential palace, adding that he was working for social and economic stability and the rotation of power.

"Opposition in Egypt does not worry me, but it has to be real and strong,'' he said in response to his critics.

Morsi also said Friday that his government would pay $5,000 to the families of those who died in the protests to oust Mubarak and $3,333 to those who were injured.

?

'New pharaoh'
The changes, announced late Thursday, prompted outrage among secularists and liberals.?

Critics accuse Egypt president of trying to become 'new pharaoh' with decree

Mohammed ElBaradei, a prominent pro-democracy figure and former head of the U.N.'s nuclear agency, accused Morsi of declaring himself a "new pharaoh."

"Morsi today usurped all state powers and appointed himself Egypt's new pharaoh," ElBaradei said on Twitter. "A major blow to the revolution that could have dire consequences."

"Morsi a 'temporary' dictator','' was the headline in the independent daily Al-Masry Al-Youm.

By ousting military chiefs, Egypt's Morsi shows he's a force to be reckoned with

The U.S. State Department signaled its concern Friday over Morsi?s declarations.

"One of the aspirations of the revolution was to ensure that power would not be overly concentrated in the hands of any one person or institution," said spokeswoman Victoria Nuland. "The current constitutional vacuum in Egypt can only be resolved by the adoption of a constitution that includes checks and balances, and respects fundamental freedoms, individual rights, and the rule of law consistent with Egypt's international commitments."

Nuland called for calm and for all parties in Egypt to resolve differences through "democratic dialogue."

Meanwhile, the United Nations expressed serious concerns Friday about human rights and stability in Egypt.

Tarek Fawzy / AP

Protesters hurl stones during clashes between supporters and opponents of President Mohammed Morsi in Alexandria, Egypt, on Friday.

"We are very concerned about the possible huge ramifications of this declaration on human rights and the rule of law in Egypt," Rupert Colville, U.N. Human Rights Commissioner Navi Pillay's spokesman, told a news briefing at the United Nations in Geneva. "We also fear this could lead to a very volatile situation over the next few days, starting today in fact."

Morsi's decree is also bound to worry Western allies, particularly the United States, a generous benefactor to Egypt's army.

It takes two to tangle: Scientists further unravel telomere biology

Thursday, November 22, 2012

Chromosomes - long, linear DNA molecules ? are capped at their ends with special DNA structures called telomeres and an assortment of proteins, which together act as a protective sheath. Telomeres are maintained through the interactions between an enzyme, telomerase, and several accessory proteins. Researchers at The Wistar Institute have defined the structure of one of these critical proteins in yeast.

Understanding how telomeres keep chromosomes ? and by extension, genomes ? intact is an area of intense scientific focus in the fields of both aging and cancer. In aging, the DNA of telomeres eventually erodes faster than telomerase and its accessory proteins can maintain it, and cells die. In cancer, tumor cells hijack the process, subverting the natural method by which our bodies limit cell growth; cancer cells, then, can grow and multiply unchecked.

One of these accessory proteins, Cdc13, is integral to telomere maintenance and essential for cell viability in yeast, according to researchers at The Wistar Institute. In a study published in the journal Structure, available online now, a team of scientists led by Emmanuel Skordalakes, Ph.D., an associate professor in The Wistar Institute Cancer Center's Gene Expression and Regulation Program, has determined how mutations in a particular region of Cdc13 can lead to defects in telomeres that could jeopardize DNA.

Cdc13 normally functions as a matched-set, where two copies of the protein form what is known as a dimer. Skordalakes found that mutations in a region of Cdc13 (called OB2) prevent Cdc13 copies from binding to each other. The findings help explain the biology of this key telomere maintenance protein, and may eventually lead to novel anticancer therapeutic if their findings translate to a similar molecular system used to maintain human telomeres, Skordalakes says.

"If we could target the OB2 region of Cdc13, for example, it would throw a wrench in the works of telomere maintenance," said Skordalakes. "If you can disrupt recruitment of telomerase in humans, you could potentially drive cells to death."

Cdc13 serves a dual function in telomere replication. First, it keeps the cells' natural DNA repair mechanisms from mistaking the telomere for a broken stretch of DNA, which could cause genetic mayhem if such repair proteins fuse the ends of two chromosomes together, for example. Secondly, Cdc13 recruits telomerase and related proteins to place in order to lengthen the telomeres.

In yeast, telomeres are decorated by a multi-protein complex called CST, which contains the proteins Cdc13 (C), Stn1 (S), and Ten1 (T). Cdc13 is a key member of that complex and serves both to cap the telomere structure and recruit key enzymes.

Skordalakes' newly determined structure demonstrates that, like three of the other four regions of Cdc13, OB2 adopts what is called an oligonucleotide/oligosaccharide-binding fold (OB). These folds normally allow proteins to bind DNA or sugars, but OB2 does neither; its crystal structure indicates that this fold actually forms a large binding surface that helps two Cdc13 proteins to form a dimeric complex.

The authors then used biochemical analyses to determine that OB2 also does not directly bind the protein Stn1. Nevertheless, full-length Cdc13 OB2 mutants deficient in dimerization are also deficient in Stn1 recruitment. When the team inserted strategic Cdc13 mutations into yeast, they found that the cells had abnormally long telomeres, probably as a result of disrupted CST complex assembly caused by impaired Cdc13 dimerization.

"The dimerization of OB2 is required for the proper assembly of the CST complex at the telomeres," Skordalakes says. "When you disrupt oligomerization of this domain, you disrupt assembly of this complex, and thus regulation of telomere length."

10 Ways to Keep the Holiday Blues Away | Apartment Therapy

holiday blues 111512.jpgAs the holiday season rolls in, it can feel like we're supposed to be diving into a constant stream of tinsel-filled parties, big happy family dinners, and presents galore. Well, it's been my experience that some years the holidays are busy and exciting, but some years they're not. Some years the holidays are awfully bittersweet, and some years the season is just flat out difficult. Whether it's financial strain, family issues, illness, loss of a loved one, or something else getting you down, this time of year can be tough!

If holiday season 2012 is looking to be tricky to navigate, here are a few alternatives to feeling blue. They're definitely more fun than sighing into your tea every time a Christmas commercial comes on TV. Yeah, I've been there too. And feel free to share your tips in the comments.

1. Host a holiday potluck. Some years it's just not possible to be with family on a big holiday, and while that can be hard, it doesn't mean you have to be alone. I learned this one Thanksgiving when I was working 1,000 miles away from my family. I couldn't afford a ticket home for the holiday, and as it turned out, neither could many of my co-workers. Rather than spending the day squirreled up in our apartments, we had a group potluck dinner. We were all in our mid-20s and the meal was hilariously hodge podge but the evening was incredibly fun: we ate bizarrely paired food and drank too much wine and played board games. So, if you think you're alone because you can't go home, think again. See what co-workers, neighbors, or friends are up to, and you may be surprised. There could be a communal holiday dinner waiting to happen.

2. Be a merry maker. According to every big box store, as of 12:01 a.m. November 1, we were supposed to start shopping for the holidays. And 10 gazillion commercials say that holiday happiness = buybuybuy. We all know that's not true, but it can still be hard to show up to holiday gatherings empty handed. Some years extra money for gifts is just not there, but that doesn't mean you can't do something special for those you care about. I have a relative who makes stunningly good chocolate confections, packages them up, and hands them out as gifts every year. It's like getting a big box of gourmet candy, but instead of spending a lot of money, she uses her time and skill. Don't be shy about tapping into your skills to make gifts. Maybe you're a baker: offer to bake the pies for a gathering. Maybe you're a gifted artist: paint a portrait of your niece or nephew or print out a particularly great photograph for a friend. Knit something, sew something, frame something, bake something, whatever you're good at, make it and share it.

3. Spruce up your pad. If you're not decorating for the holidays, use your creative energy and extra time off to fix up your place. That's what I did one Christmas Eve. I was living alone, working most of the holidays, my mom was recovering from cancer surgery and there was nothing particularly eventful to mark the days off. Tired of moping around, I decided to repaint my bedroom. I picked up a gallon of paint at a local hardware store and painted late into the night while listening to Christmas music and drinking wine. It turned out to be a great evening of introspection and I woke up on Christmas morning in a fresh and bright, lemon souffl? colored room.

4. Get excited about the year ahead: Make plans! Even if nothing is particularly wrong, some years the holidays are just kind of lackluster and there isn't much going on. Instead of feeling sad because it feels like everyone else is talking about how busy their social calendar is, get excited about things to do and places to go in the coming year. Having a trip, project or goal on the horizon can make those dull New Year's Eves less of a bummer.

5. Giving is better than receiving. Not getting invited to a holiday party is a drag, it definitely stings, but if that's a major concern, it means the basic needs are probably covered. For so many, the holidays are incredibly difficult because their basic needs are not met, and this is where we can help. Countless organizations are looking for volunteers to help with clothes, food, toy drives or meal-related events around the holidays. If you're looking for a volunteer opportunity for the holidays, United We Serve is a great place to start. Type in your zip code for a listing of local opportunities.

6. Be of good cheer. It's easy to fall into a bad mood if the family is giving you fits and money is tight and the boss won't let you have time off, but instead of getting Scroogey, do a 180. Take a look around see who could use a hand or a high five. Then give it to them. Does an elderly neighbor need a meal? Make one and deliver it. Maybe a friend just lost a job or is going through a break-up: take them out to dinner or for a drink. Volunteer to babysit for someone you know needs a night out. Put some extra cash in the barista's tip jar. Wink at the bus driver. Compliment your co-worker's bedazzled holiday sweater they worked so hard on. Smile at a grumpy store clerk, well, that'll probably just annoy them, but you get the gist. Little gestures can make a big impact on another person's day, and you can boost your own spirit just by being thoughtful. It's a phenomenon called helper's high, and it refers to your body's natural release of happy endorphins when you do good deeds. So go ahead and be the one who wears the goofy Santa hat at work.

7. Take a hike. I mean that in the nicest way possible, as in, truly, take a hike! Really, is there anything better than a long, brisk walk in the fading afternoon light to clear your head and lift your spirits? Whether you love to load up your iPod and ramble through your neighborhood, or hike a favorite trail while listening to the rhythm and silence of nature, a brisk walk is a fine way to spend a quiet holiday afternoon.

8. Travel. I recently read an article in The New York Times that promoted the idea of solo leisure travel during the holidays. I love this idea! If you have some extra money but no real plans, why not use the time off to go somewhere new? Adventure is always a good idea, and isn't there something completely charming about hotels during the holidays? I think it's how much they tend to overdo it ? it's like x-treme coziness.

9. Re-connect with a handwritten letter, phone call or lunch date. Tis' the season for holiday cards, so why not use this time to truly reconnect with someone you're missing? We may be "friends" with everyone we've ever known on Facebook, but browsing through clever status updates and carefully curated pictures (see: everyone always looks good + smiling) doesn't compare with hearing someone's voice or reading a handwritten letter.

10. Disconnect from the noise. Social media and mobile devices are a major presence in many of our lives and they're wonderful tools to help us communicate and connect; but if the holidays are a time of personal crisis, the noise of social media can create additional stress. Sometimes the last thing we need to be thinking about is what fancy restaurants our friends are "checking in" at, or how drunk our second cousin half-removed got at the holiday work party, or how disappointed a former co-worker is that he didn't get an iPad for Christmas. A holiday break-up with social media might give you some much needed internal respite; I know quieting my life has helped me during stressful times. And remember, you can always get back together in January. Yes, no matter how many times I break up with Facebook and my cell phone, they always get me back.

Clinton, White House denounce bus bombing

U.S. Secretary of State Hillary Rodham Clinton and Israel's Prime Minister Benjamin Netanyahu deliver joint statements??Secretary of State Hillary Clinton denounced a bomb attack on a bus in Tel Aviv that wounded at least 10 people even as she worked to help cobble together a truce between Israel and the Palestinians' Islamist Hamas movement that rules Gaza.

"The United States strongly condemns this terrorist attack, and our thoughts and prayers are with the victims and the people of Israel," said Clinton, who has been meeting with leaders of Israel and Egypt as well as Palestinian Authority President Mahmoud Abbas. Abbas' government runs the West Bank.

"As I arrive in Cairo, I am closely monitoring reports from Tel Aviv, and we will stay in close contact with Prime Minister Netanyahu's team. The United States stands ready to provide any assistance that Israel requires," Clinton said in a written statement.

Hamas has welcomed the attack, even as the White House joined in the denunciations.

"The United States condemns today's terrorist attack on a bus in Tel Aviv," press secretary Jay Carney said in a statement. "Our thoughts and prayers are with the families of those injured and with the people of Israel.

"These attacks against innocent Israeli civilians are outrageous. The United States will stand with our Israeli allies and provide whatever assistance is necessary to identify and bring to justice the perpetrators of this attack," Carney said. "The United States reaffirms our unshakeable commitment to Israel's security and our deep friendship and solidarity with the Israeli people."

YouTube's biggest sports deal so far will bring live NBA DLeague games Friday

This summer YouTube made its biggest advance into sports by picking up rights to live stream the Olympics in various countries, but now it has gained a domestic foothold by partnering with the NBA to air D-League games. While the world isn't exactly beating down the doors to watch minor league basketball, this is YouTube's biggest pro sports deal so far. Neither the NBA nor Google will say how much the rights cost for it to air 350 or so of the league's 400 games, but we wouldn't expect to see YouTube bids for Monday Night Football. The NBA has long been a YouTube partner in other deals, and there were rumors last year that they were considering a deal for games, although right now Google seems to have its eye on ESPN3 instead of ESPN and will focus on niche sports and complementary programming. If you're a fan of the Fort Wayne Mad Ants or just trying to catch a peek at the next Jeremy Lin before everyone else, the broadcasts start Friday night (in HD) with four games. They're also accessible via team and league websites, as archived VOD on YouTube, through mobile apps for iOS and Android or, of course, on TV when they air on NBA TV and CBS Sports Network.

4 teams advance as Chelsea nears elimination in CL

By JEROME PUGMIRE

AP Sports Writer

Associated Press Sports

updated 12:36 a.m. ET Nov. 21, 2012

PARIS (AP) -Barcelona, Bayern Munich, Shakhtar Donetsk and Valencia reached the knockout stage of the Champions League on Tuesday, while Chelsea is on the verge of becoming the first titleholder to fail to make it out of the group stage.

Already under pressure in the Premier League after a four-game winless run, Chelsea lost 3-0 at Juventus to drop to third in Group E behind Shakhtar and Juve and place manager Roberto di Matteo under increasing pressure.

"At the moment I'm still here and I think I will be in the future. We'll have to see what happens," said said Di Matteo, who spent more than an hour with his players in the dressing room. "I'm responsible for the result, I'm responsible for the performance and tonight was negative. If anyone has to take the blame it's me. I select the team."

Fabio Quagliarella and Arturo Vidal - both on target for Juventus in the 2-2 draw at Stamford Bridge - again scored against a Chelsea team without the dropped Fernando Torres and injured John Terry. Substitute Sebastian Giovinco capped the victory with a goal in the final minute.

"It's a big disappointment," Di Matteo said. "It's been a difficult evening for us, for the team, for the club. So there was a lot of reflection."

Shakhtar showed it is a force to be reckoned with after a crushing 5-2 win over FC Nordsjaelland, with Luiz Adriano scoring a hat trick and Willian grabbing two goals.

Chelsea has to beat Nordsjaelland and hope for Shakhtar to defeat Juventus to go through at Juve's expense.

"It's mathematically still possible. And you always try while there's still hope," Di Matteo said. "Who says Juve are not going to lose against Shakhtar?"

Juventus assistant coach Angelo Alessio insists the players will not settle for a draw in Ukraine because "we're not used to playing for a point, we want to win."

In Copenhagen, Nordsjaelland took the lead but Shakhtar equalized two minutes later in a contentious moment that enraged the crowd.

Willian kicked downfield after an uncontested drop ball toward the opposing box because of an injury to a Nordsjaelland player. The hosts' defenders walked slowly to the ball, only to watch in amazement as Adriano raced through to score.

Barcelona advanced for the ninth straight season after defeating Spartak Moscow 3-0 in Group G with Lionel Messi scoring another two goals to close to within five of Gerd Mueller's single-year record of 85.

"Messi is a perfect player, maybe the best player in the world right now," Spartak coach Unai Emery said.

Daniel Alves put Barca ahead and Messi pounced twice before halftime to continue a remarkable season that includes 17 league goals and another five in the European Cup. He has 56 Champions League goals in his career, tying Ruud Van Nisterooy for second place and trailing only Raul Gonzalez's tally of 71.

Two weeks after beating Barcelona at home in one of its best ever European performances, Celtic lost 2-1 at Benfica to remain level on seven points with its Portuguese opponent.

At first glance, Celtic would seem to have the odds slightly in its favor when it hosts Spartak and Benfica travels to Barcelona on Dec. 5. But if both matches end in a draw then the Portuguese club will advance.

Argentine defender Ezequiel Garay volleyed home in the 71st to give Benfica the win it needed to stay in the tournament following a 32nd-minute equalizer from Greek forward Giorgos Samaras. Dutch striker Ola John gave Benfica an early lead with his first goal for the club.

Bayern, last year's finalist, and Valencia both advanced from Group F after drawing 1-1 in Spain, extinguishing Belarusian side BATE Borisov's slim chances of qualifying.

Valencia went down to 10 men in the 33rd minute after right back Antonio Barragan was sent off but went ahead thanks to midfielder Sofiane Feghouli's goal in the 77th. Thomas Mueller equalized five minutes later with a shot that grazed Feghouli.

"We put in a huge effort and did the best we could because they are a great team, so we are really very happy," said Feghouli.

Lille salvaged some pride from a miserable campaign by winning 2-0 at BATE, its first win of the competition. But the French club failed to score enough goals to stand a chance of qualifying ahead of BATE for the Europa League.

Already-qualified Manchester United lacked firepower in losing 1-0 at Galatasaray after fielding an under-strength team.

United, which left key players at home after losing 1-0 at Norwich in the Premier League at the weekend, was unable to respond to Burak Yilmaz's header at the start of the second half. Yilmaz has scored all five goals for Galatasaray in Group H.

"Parts of the game were good but the area in which we were worried about - set-pieces - we suffered," United coach Alex Ferguson said. "That was always going to be a worry for us."

The Turkish side remains in second place ahead of CFR Cluj on head-to-head record. Both sides have seven points with one game remaining. Cluj remains in the hunt for a knockout berth after beating Braga 3-1 following a hat trick from Rui Pedro.

In the last round of matches in two weeks, Cluj visits United while Galatasaray travels to eliminated Braga.

Windows 8 sales have been 'slow going,' Microsoft said to be blaming OEMs

Windows 8 sales have been 'slow going,' Microsoft said to be blaming OEMs

We've already heard about Windows RT's "modest" beginning, and now there's talk full-blown Windows 8 ain't flying off the shelves either. According to MS aficionado Paul Thurrott and his insider sources, uptake of the new OS isn't hitting Redmond's targets, with the blame being put on OEMs and their "inability to deliver" more inspiring hardware with better availability. Some corroboration of Windows 8's tricky birth comes from Merle McIntosh, senior VP of product management of NewEgg, who says the online retailer was "prepared for an explosion" at launch, but that sales have "been slow going" to date. However, he says that early sales figures shouldn't be compared to Windows 7, since that OS arrived to "solve a Vista problem." He expects Windows 8 to gain traction in Q2 2013 when "pricing normalizes," which would certainly help to temper any launch frustrations.

Royal Commissions- Preventing A Person From Giving Evidence ...

As the effectiveness of a Royal Commission is heavily reliant on the ability to summon witnesses and require them to give evidence and/or produce related documents, section 6L of the Royal Commission Act establishes an offence and penalty for preventing a person from giving evidence or producing a document. Section 6L states:

?

(1)? Any person who intentionally prevents any person who has been summoned to attend as a witness before any Royal Commission from attending as a witness or from producing anything in evidence pursuant to the summons to attend shall be guilty of an indictable offence.

Penalty:? Imprisonment for one year.

?

(2)? Any person who intentionally prevents any person who is required to produce a document or other thing pursuant to a notice under subsection 2(3A) from producing that document or thing in accordance with the notice is guilty of an indictable offence.

Penalty:? Imprisonment for 1 year.

?

As can be seen, the penalty for either intentionally preventing a person from attending a Commission or from producing evidence, including a document or other thing pursuant to a notice, is imprisonment for 1 year.

?

A Royal Commission is a very complex legal proceeding.? Any person who is required to appear before a Commission should obtain expert legal advice prior to attendance.

Baby Blue Streak

Pregnant Cursing

I didn?t really think anything about about my frequent, enthusiastic swearing until I got pregnant. But then, something about seeing me unleash a rousing string of epithets from behind my huge belly started making my husband wince. Even my mother, who once laughed when she heard my wee self let slip a ?shit,? was moved to comment after she heard me on a recent DoubleX Gabfest describe myself as ?so fucking pregnant.? ?You might want to tone it down,? she said, gently. I suppressed the urge to tell her to piss off.

But was my swearing affecting the baby? ?Your curious baby is listening in to your conversations at 34 weeks,? one of my weekly pregnancy email newsletters informed me. ?Some say that baby will recognize songs mom sings while he?s in the womb, and may even be more easily soothed by them if he?s used to them once he?s on the ?outside.? ?

Oh, man. What ?song? is my baby hearing? Maybe my little girl will feel that first burst of antiseptic cold from the bright hospital room, open her eyes, and scream, ?Fuuuuck!!!? Maybe she?ll start sassing the nurses cleaning her tiny bottom, like a two-bit movie gangster: ?Goddammit, dames, could we move it along here?? All fantasies aside, learning that my baby was eavesdropping on me while still in utero also made me reflect on the influence I?m already having on my daughter, and whether my unfettered use of the F-word is something I want her to experience with her first consciousness.

Though cursing was not a big deal in my household growing up, my parents did not curse anywhere near as much as I do now. I wasn?t so F-word-friendly myself until college. Before that, I was always the straight-A captain of the field hockey team, innately understanding that a degree of wholesomeness was an important part of the package. Looking back, I wonder if I started cursing so heavily because I needed to move away from that earlier good-girl persona, which ultimately I found stifling. ?I hope my daughter doesn?t need something as superficial and potentially off-putting as cursing to develop her sense of self.

More immediately?and selfishly?I?m concerned about how my daughter?s potty mouth might reflect on my husband and me. I really don?t want to be called into daycare two years from now because my daughter has been teaching all the other toddlers to complain about their shitty diapers. And I don?t want to be shunned at the playground while trying to meet new mom friends because I can?t keep my language PG.

Research on the effects of cursing on fetuses is inconclusive. I asked Annie Murphy Paul, the author of Origins: How the Nine Months Before Birth Shape the Rest of Our Lives, about how much of an impact cursing has on babies in the womb. She backed up my pregnancy newsletter: Newborns can recognize their mother?s voices at birth, and they can even recognize stories and songs if they heard them repeatedly before they were born. But according to Paul, babies can?t ?discriminate among curse words or other words.? What babies and fetuses do respond to, however, is extreme maternal stress. But we?re talking war-zone, Hurricane-Sandy-destroyed-my-house level stress, not my-boss-was-being-a-jerk-today stress. Cursing can certainly go along with intense personal upheaval, but it?s a symptom, not a cause.

As for older children, the research is similarly incomplete. One 2009 study published in the journal Psychology, Public Policy, and Law pointed out that some of the extant research is based on a family verbal abuse measurement scale called the Conflict Tactics Scale?which does not separate conversational swearing from insulting swearing. There?s a big difference between cursing around your kid and cursing at your kid. The former is verbal abuse; it?s unclear whether the latter has a negative impact. Another study, from a 2011 issue of Pediatrics, showed that adolescents who consumed more profanity-laden media were more likely to be aggressive, both physically and relationally. Still, that study does not explore the context of the profanity, and it doesn?t really talk about how profanity used at home affects children.

Child psychologist Alan Kazdin, director of Yale?s Parenting Center, says he isn?t aware of any studies that isolate swearing from other negative parental behaviors. ?If you?re an otherwise supportive and loving parent who happens to curse, it?s probably not that big a deal. However, he does say that if you curse around your kid, it?s likely they will model that behavior. And once they?re cursing, it?s quite difficult to get them to stop. Telling your child, ?I can do this because I?m grown up and you aren?t,? says Kazdin, is woefully ineffective. ?It?s like when your boss takes off early all the time and you aren?t allowed to??it breeds resentment.
